Terms of Service

These Terms of Service ("Terms") govern your use of the Fretwerk app and website ("Fretwerk," the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Fretwerk. By using the Service you represent that you meet this requirement.
2. Your account
You are responsible for the activity that happens under your account and for keeping your login credentials secure. Provide accurate information when you register, and let us know promptly if you believe your account has been compromised. You may close your account at any time from within the app (Profile → Delete Account).
3. Acceptable use
When using Fretwerk, you agree not to:
- Choose a username or display name that is offensive, harassing, impersonating, or otherwise inappropriate. We use automated filtering and may remove or reset names that violate this rule.
- Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its systems.
- Use the Service to violate any applicable law or the rights of others.
- Manipulate or falsify practice activity or leaderboard standings.
We may suspend or terminate accounts that violate these Terms.
4. User content
Fretwerk lets you create content such as a chosen display name and tabs in the Tab Builder. You retain ownership of content you create. By choosing a display name, you grant us permission to show it to other signed-in users as part of the leaderboard feature. You are responsible for the content you submit and must have the right to use it.
5. Intellectual property
The Fretwerk app, including its design, code, lessons, and other original content, is owned by Fretwerk and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial learning. Song titles and artist names referenced in lessons are used for educational identification only and remain the property of their respective owners.
6. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or that pitch detection and tuning will be accurate in every environment.
7. Limitation of liability
To the fullest extent permitted by law, Fretwerk will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service.
8. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service.
9. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the state and federal courts located in California.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Effective date" above and, where appropriate, notify you in the app. Continued use of the Service after a change means you accept the updated Terms.
